Our Privacy Policy

Your privacy is our concern. The U.S. Department of Health and Human Services (“HHS”) issued the Privacy Rule to implement the requirement of the Health Insurance Portability and Accountability Act of 1996 (“HIPPA”). The Privacy Rule standards address the use and disclosure of individuals’ health information – called “protected health information” by organizations subject to the Privacy Rule. In compliance with state and federal regulations SOUTH JERSEY HOME CARE (AGENCY) will maintain your “protected health information” for a period of time in compliance with state regulations. A privacy official designated by the AGENCY will maintain the confidentiality of said records. AGENCY will not knowingly disclose, or permit disclosure of, any personal information except to protect your health or safety in an emergency situation. AGENCY also reserves it’s right under the law to release your records to any state or federal agency which presents a subpoena for such records. It is your right to add or subtract to the list of individuals permitted access to your case information. Please submit your request in writing to AGENCY.

Obtaining “consent” (written permission from individuals to use and disclose their protected health information for treatment, payment, and health care operations) is optional under the Privacy Rule. The content of a consent form, and the process for obtaining consent, are at the discretion of the AGENCY electing to seek consent.

Informal consent may be obtained by asking the individual outright, or by circumstances that clearly give the individual the opportunity to agree, acquiesce, or object. Where the individual is incapacitated, in an emergency situation, or not available, disclosure is determined to be in the best interest of the individual.
